What "amicable" means in a divorce sale
Amicable does not mean conflict-free. It means both spouses agree to sell, agree on the REALTOR®, roughly agree on listing price, and have either a signed separation agreement or a clear letter of direction from both lawyers. Hard conversations still happen — about pricing decisions, offer reviews, possession dates — but the parties are working toward the same outcome.
Phase 1: Pre-listing paperwork (Days 1-7)
- Both spouses meet with KARAKTER (separately or together) for a property walkthrough and listing strategy discussion.
- Both spouses sign the Exclusive Seller Representation Agreement (ESRA), with electronic signature via DocuSign if preferred.
- Letter of direction from both lawyers regarding pricing authority and offer review process is obtained.
- Property Disclosure Statement (PDS) is reviewed and signed by both spouses or the occupying spouse (with the other reviewing).
- RPR is ordered if not already current — this is the most common source of delays. Alberta RPRs take 3-6 weeks; the longer it takes the more it can push closing.
Phase 2: Property preparation (Days 7-14)
- Decluttering, cleaning, minor repairs as agreed in the listing strategy.
- Professional photography scheduled — typically a single shoot day, exterior + interior.
- Pricing finalized based on KARAKTER's comparative market analysis (CMA), which goes to both spouses and both lawyers as a single document.
Phase 3: Active on MLS (Days 14-42)
- Listing goes live; KARAKTER coordinates showings around occupying spouse's schedule.
- Showing feedback emailed to both spouses and both lawyers within 24 hours.
- Calgary average days on market is approximately 24 days (CREB April 2026). Spring listings (March-May) typically move faster; winter listings (November-January) may extend to 30-45 days.
- If price adjustment is needed, KARAKTER's recommendation goes to both spouses simultaneously. Both lawyers receive the analysis.
Phase 4: Offer and condition clearance (Days 28-50)
- Offer received; presented to both spouses in writing with KARAKTER's recommendation. Lawyers copied.
- If both spouses agree, offer is accepted with conditions (typically financing, inspection, condo doc review if applicable).
- Condition period: 7-14 days. Buyer completes inspection, finalizes mortgage approval. Each step's status is communicated to both spouses.
- Condition waiver received → property is firm/sold.
Phase 5: Pre-completion (Days 42-70)
- Buyer's lawyer prepares transfer documents; sellers' lawyer coordinates with both spouses.
- Both spouses provide ID, sign closing documents (often via separate appointments).
- Mortgage discharge requested from existing lender.
- Occupying spouse arranges movers; vacant by possession date.
Phase 6: Completion and possession (Days 60-90)
- Completion day: title transfers, buyer's funds land in sellers' lawyer trust.
- Possession day: keys handed over; occupying spouse vacates.
- Proceeds distribute through both lawyers per the separation agreement or court order. Typically 5-10 business days after completion.
Common variables that extend the timeline
- RPR delays: if compliance issues are identified, resolution can add 2-4 weeks.
- Disagreement on offer review: if both spouses can't align on a counter, the lawyers may need to intervene.
- Market conditions: in slower markets, days on market can stretch 45-60 days.
- Buyer financing issues: a buyer whose financing falls apart late in the process can collapse the deal.
